Welcome to Popup School! These Terms of Service (“Terms”) govern your access to and use of the Popup School mobile application, website, and any related services (collectively, the “Service”), operated by Popup School Inc. (“Popup School,” “we,” “our,” or “us”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to create a parent account. The Service is designed for children ages 7–13, but only a parent or legal guardian may create and manage a child profile.

2. Description of the Service

Popup School allows parents to manage their child’s device screen time by requiring completion of educational lessons (e.g., Math or ELA) before selected apps can be unlocked. The parent app controls all lock/unlock settings for the child’s device.

3. Parent Responsibility

You acknowledge and agree that:

Popup School does not monitor or control what third-party apps your child uses once they are unlocked.

4. Accounts and Security

You must provide accurate and complete information when creating an account. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.

Popup School is not liable for any loss or damage arising from unauthorized use of your account due to your failure to safeguard your credentials.

5. Subscription & Payments

Popup School may offer free tiers, promotional trials, or paid subscription plans. By starting a subscription, you authorize Popup School and/or the applicable app store to charge your payment method for recurring fees until you cancel.

You can cancel your subscription at any time via your device’s app store subscription settings or by following instructions provided within the Service. Unless required by applicable law, payments are non-refundable and there are no refunds or credits for partial periods.

7. Intellectual Property

All educational videos, lesson content, designs, interfaces, logos, trademarks, and related assets are the property of Popup School Inc. or its licensors and are protected by intellectual property laws.

You may not copy, reproduce, modify, distribute, or create derivative works based on any part of the Service without our prior written permission.

8. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection, use, and disclosure of information as described in that policy.

9. Disclaimers

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not guarantee that:

10. Limitation of Liability

To the maximum extent permitted by law, Popup School Inc. and its officers, directors, employees, and agents are not liable for any indirect, incidental, consequential, special, or exemplary damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claim relating to the Service will not exceed the amount you paid to Popup School Inc. for the Service in the twelve (12) months preceding the claim.

11. Modifications to the Service or Terms

We may modify or discontinue all or part of the Service at any time, temporarily or permanently, with or without notice. We may also update these Terms from time to time.

When we make material changes, we will update the “Last Updated” date at the top of these Terms and may provide additional notice through the Service. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in Massachusetts, and you consent to the personal jurisdiction of such courts.
